A Jefferson Circuit judge has disqualified a Republican candidate for the Kentucky House due to a filing error, stating that her signatories when she filed did not live in her Louisville district at the time, as required by law.

Republican nominee Susan Tyler Witten, who won the GOP primary for House District 31 in May with 76% of the vote, indicated after the Wednesday ruling that she plans to appeal so she can stay in the race.

Sue Foster, her Democratic opponent in the general election, filed a petition two weeks ago to have Witten disqualified, arguing that she and her two signatories did not live in District 31 when she filed for office Jan. 19 — which was the day before legislative redistricting went into effect.
